A man accused of abusing his pregnant wife

He was charged under Art. 323 of the Penal Code in connection with Art. 326A of the same code.

Kota Kinabalu: On Tuesday, in the Magistrate’s Court, the seller was charged with assaulting his pregnant wife. Ag Zulfadhli Ag Mohd Ali, 31, who appeared before Magistrate Lovely Natasha Charles, pleaded not guilty to the charges against him.

He was accused of voluntarily causing harm to his wife on May 23 this year at 12:01 at the house in Kg Tanjung Aru lama. He was charged under Art. 323 of the Penal Code in connection with Art. 326A of the same code. Section 323 provides for imprisonment of up to one year or a fine of up to RM2,000 or both on conviction, while Section 326A states that anyone who causes harm to his or her spouse or ex-spouse, child, disabled adult or other family members and commits an offense under Art. 323, 324, 325, 326, 334 or 335, shall be punished by imprisonment for a period twice as long as the maximum period for which he could be sentenced for the offense. Inspector Kelvan Elson Maik, prosecutor, seeking pre-trial case management (ptcm), offered bail of RM3,000.

The court fixed July 2 for ptcm and released the accused on bail of RM2,000 under two sureties. In another case, a 39-year-old man was sentenced to three years in prison and caned three times for possessing 12.73 g of syab.

Julhari Allus admitted that he had a syabu on October 4, 2023 at noon in Sepanggar. He was charged under Art. 12 section 2 of the Act on Dangerous Drugs and is punishable under Art. 39A section 1 of the same act, which, if convicted, is punishable by imprisonment from two to five years and flogging from three to nine strokes.
